This is my second time getting ripped off on ebay. I bought two lps within a few minutes of each other. The seller said to combine shipping if 2 or more lp's were won. He advertised paypal but after winning he said "paypal is over limit, please send payment via billpoint or other method". I sent him a USPO money order. He sent one lp but not the other. I let him know I received one and was surprised he did not send both in the same package. He said he never received payment for the second one. Since then I have sent him a copy of the MO but he keeps e-mailing as if he has not received any response. Today, I receive an ebayer no payment warning. Appearantly I'm allowed 3 of these before my ebay priveledges are revoked. I got his phone number from ebay. No answer all day.

My question, Can I report the MO lost or stolen? If so will that cause him some big problems? After all, he is saying he never received it. (I know damn well he cashed it because he would have never sent me the first lp). I hate to get a negative feedback just because the guy is a looser. I want to cause as much problem as possible since he is trying to pull something. Any advice? Sounds mean but you know, I paid for the thing...

Go grab a hotmail email account, and use it, identify yourself clearly to him as to who you are.

Postal Money order & no goods = Mail Fraud, a federal offense. Up to you how you want to 'remind' him of that.

Keep us posted, and share his ID with us (if you deem ok).

Sorry to hear your problem Max. The MO receipt should have some contact information on the back. Yes you can claim it stolen or lost, BUT he has probably already cashed it and I don't think they can do too much either way.

I "think" that your best recourse is to contact the MO issuer, and go from there. They can track whether it has been cashed or not, but I believe they charge you for an actual document stating that fact.

If it ends up real bad, no luck, post his phone number and I will tack him into the War Dialer. We will see how he feels about constant phone calls for 2 weeks, nonstop.

I was thinking I explain the fraud thing as if the MO was stolen. God help the person who cashed it. From there, I have no problem calling him hour on the hour until he answers. Lets see, 12:00, 12:50, 1:20, 1:55, ...etc. It is now 10:00. Sorry, I have to make a call. Rip ME off for $7 will ya???

Well, here was the message I sent him...

"Hi,
I've been trying to call you all day, guess you were not home. I reached your housecleaner about 1:00 but he was not sure when you would be home. Good luck on the mess! Good news. I can report the Money order lost/stolen. It will take about 3 weeks to sort it out but once they figure out if someone actually cashed it then God help that person! (federal... heh heh) We'll teach them a lesson! I am so glad I used a USPS MO. If it were a western union I would be out of luck. I hate to say this but if the end of the report period for feedback is close before an answer is received then I am afraid I will have to leave negative feedback. Sorry, but that is the way it goes. At least you will have the knowledge that the looser who got the MO will get his. In any case we will teach this $^@&#$% person a lesson. :) If you shipped out the other lp before payment I'm sorry. Once I get satisfaction with the person who cashed the MO I will make it up to you."

I know, I'm full of it but I really am going to report the MO as lost or stolen. I mean, he says he never received payment...

Max.........jesus y cristo.........a note to someone that you're pissed about them stiffing you doesn't EVER, and I mean EVER include hehe's and smileys. You're not on the same team as him, so there's no "We'll" to talk about. Balls up here and don't come off as a pushover..........

You need to pin him to the wall and raise hell until he does something about it. If he's not under the impression that the single money order covered both auctions, fax him a copy of the MO, with a printout of both auctions and see what he says. Leave negative feedback as you should, but don't act all buddy buddy with him. He's not doing you any favors, and he's not your partner to catch the mysterious person who cashed the MO.

Good luck getting it resolved..........but PLEASE.....don't write notes to people claiming to be pissed where you come off as a pussy.........

(not that i'm calling you one.....just a bit of constructive criticism)

have you contacted E-bay? they do cover up to $200.00

so what is the claim for ? 7 bucks... I hate loseing money as well and i would leave neg feedback and contact e-bay, but i wouldn't be getting all haywire over this amount, I have been on e-bay for years also and have never gotten stiffed, BUT almost a few times but on much larger amounts and their really still was nothing that could be done. In the end its really hard to get someone to do something, much less for 7 bucks.. Not that i think any amount is ok to get stiffed for, I also agree with Brettw on this.. Get in his face and if you don't get anywhere, well your right where you are now anyways, Seems these people who sell LP's are kinda shady.. werent you the one who go stiffed and those people were screwing people all over e-bay?? sheesh, just be careful i guess or get your Lp's elsewhere. the money your saving you might end up loseing it seems

madmax, what does his feedback say? Does he have several negative feedback? That right there will be big clue whether this guy is lying or not. If he has no negative feedback.. then maybe indeed he never received the MO. If he has several neg feedbacks, then he's a looser.

I'm willing to give him a little slack. But as Brett said... don't be a pushover. Stand your ground.. you never received the LP. but sometimes there are circumstances beyond the control of you or the seller.

That why I use postal money orders to pay. Verifiy it has been cashed and turn it over as MAIL Fraud....... After it has been verified as cashed inform the seller that "MO has been verified cashed and you reported it as MAIL FRAUD".

Sit back and See what happens then. File a claim with Ebay for the lost funds, if the item finnaly turns up or you receive a refund of the money order you will have to return the EBAY claim.

How does cashing a money order (allegedly) and not sending a item = mail fruad... it was sent to him, he (allegedly) opened it and cashed it in his name. I'm not sticking up for him by no means shape or form before you guys get mad at me, nor do i wanna fight about anything, BUT you have to put a tracer on the MO to see when/if and where it was cashed.. they will get a copy of the signed money order and see who signed it, do a claim with e-bay and be done with it.. to save you some grief.. The whole mail fruad thing is alittle bit much, I think "IF" he is scamming you.. he is your typical e-bay shister at best, IMHO and that is all...

were talking about busting the guy for a scam your not even sure happened yet anyways, if he didn't receive the MO, then he still shipped the first LP free.. and if you do a claim with e-bay you get your money back and the LP...


I just don't want you to beat yourself up over it, when their are (imo) easier ways to go about it, shoot im in for a buck or 2 to help recover your money if anyone else is in?? Its just not worth it unless were talking i don't know over 20-30 bucks and up to 100.00 or more ... then i would be pissed!!!!!!!!

I can't even count how many letters I've written to companies/people where I've chosen to let them know of the shitty service that they've provided. He replied back this morning. He says he will send it to me. No real explanation. He said he wouldn't read any of my emails because they all have viruses attached to them. (although he replied to one of them and knew what I was talking about in others). I'll believe it when I see it.

He had quite a few negatives which explained the same problems I am having. It's $7 though. I'm not bent about it. He knows fully well what to expect from people so I decided to try a different approach and send something unexpected. IS THAT OK BRETT?

It's all in fun but I hate to see the average guy loose money, get bad feedback and get a non-paying bidder notice for nothing more than sending payment for his order. (especially if it is me)

Side note, I don't think ebay would have been of any financial help here as they eat the first $25 of any claim as a "processing fee"...
