The main issue appears to be that the video was not taken by someone nearby, but recorded on a portable device from play back of the mall's surveillance tapes. Her other concerns will be pushed because of how the video was obtained.

Those recordings can be released to anyone for any reason. Its not illegal. Whether or not they'll find some activist judge to hear the case is a different matter.
