    Iraq Veteran Sues Michael Moore Over '9/11'

    "BOSTON (June 1) - A veteran who lost both arms in the war in Iraq is suing filmmaker Michael Moore for $85 million, alleging that Moore used snippets of a television interview without his permission to falsely portray him as anti-war in "Fahrenheit 9/11."

    Sgt. Peter Damon, a National Guardsman from Middleborough, is asking for damages because of "loss of reputation, emotional distress, embarrassment, and personal humiliation," according to the lawsuit filed in Suffolk Superior Court last week. Damon, 33, claims that Moore never asked for his consent to use a clip from an interview Damon did with NBC's "Nightly News." He lost his arms when a tire on a Black Hawk helicopter exploded while he and another reservist were servicing the aircraft on the ground. Another reservist was killed in the explosion.

    In his interview with NBC, Damon was asked about a new painkiller the military was using on wounded veterans. He claims in his lawsuit that the way Moore used the film clip in "Fahrenheit 9/11" - Moore's scathing 2004 documentary criticizing the Bush administration and the war in Iraq - makes him appear to "voice a complaint about the war effort" when he was actually complaining about "the excruciating type of pain" that comes with the injury he suffered.

    In the movie, Damon is shown lying on a gurney, with his wounds bandaged. He says he feels likes he's "being crushed in a vise." "But they (the painkillers) do a lot to help it," he says. "And they take a lot of the edge off of it."

    Damon is shown shortly after U.S. Rep. Jim McDermott, D-Wash., is speaking about the Bush administration and says, "You know, they say they're not leaving any veterans behind, but they're leaving all kinds of veterans behind."

    Damon contends that Moore's positioning of the clip just after the congressman's comments makes him appear as if he feels like he was "left behind" by the Bush administration and the military.

    In his lawsuit, Damon says he "agrees with and supports the President and the United States' war effort, and he was not left behind." He said that, while at the Walter Reed Army Medical Center recovering from his wounds, he had surgery and physical therapy, learned to use prosthetics and live independently. He also said that Homes For Our Troops, a not-for-profit group, built him a house with handicapped accessibility.

    "The work creates a substantially fictionalized and falsified implication as a wounded serviceman who was left behind when Plaintiff was not left behind but supported, financially and emotionally, by the active assistance of the President, the United States and his family, friends, acquaintances and community," Damon says in his lawsuit.

    Moore did not immediately return calls seeking comment Wednesday. A message was left for Moore at a personal number in New York and with HarperCollins, publisher of Moore's 2002 book, "Stupid White Men...And Other Sorry Excuses for the State of the Nation!" A spokesman for Miramax Film Corp., also named as a defendant, did not immediately return a call. Damon did not immediately respond to a request for an interview.

    "It's upsetting to him because he's lived his life supportive of his government, he's been a patriot, he's been a soldier, and he's now being portrayed in a movie that is the antithesis of all of that," Damon's lawyer, Dennis Lynch, said. Damon is seeking $75 million in damages for emotional distress and loss of reputation. His wife is suing for an additional $10 million in damages because of the mental distress caused to her husband, Lynch said."

    At least Limbaugh tries to come up with some original ideas and try to defend them in fact (even if he is an overly arrogant tool half the time). Also, a big difference: Most people know/realize that Limbaugh is stating his opinion while Moore tries to play it off as fact and not opinion.

    Rush is like Michael Moore, being that he's a hypocrite of the highest order. He shows his ignorance on feminism, equal rights, the constitution, and even racial issues be it either on his own radio show or ESPN.

    Of course this only applies to everyone else..

    That being said, I do have sympathy for him due to his hearing loss, and past(?) drug addictions -- that has to be tough. I also appreciate his annual fundraiser for Leukemia.

    But I still don't like the guy.

    The problem I have is that he still gets to advertise his crap as "documentarties" which to me implies a factual representation of what happened and a decent presentation of both sides of the issue. He fails in both of those accounts. If they could somehow move away from the "documentary" label I'd be ok with it.

    Michael Moore and limbaugh have two very different styles-

    MM takes a limited set of facts, then lays them out to create a somewhat deceptive picture.

    RL talks out his ass then claims he never said what he did.

    Content aside, you kinda have to admire the style of each:
    MM because it's so subtle. It's damn near impossible to catch him in a lie- everything is just slightly out of context, taped together, and next thing you know it's something else entirely.

    RL on the other hand has perfected the art of talking louder than you. Read him a transcript of what he said, and he'll deliver a "it wasn't me" that would do the biggest playa' proud.

    The problem is he was never violating the law. Its not against the law to get hooked on Oxycontin (spelling?)

    Limbaugh had massive back surgery and then not too long after had a hole drilled into the side of his head and a magnet and impant stuck in there. You can imagine the pain!!! With this much pain, the only things that are going to help it would be something extremely addictive like oc or morphine.

    As for the criminality of it, after a 3 year investigation by the Florida DA, they couldnt find anything. Rush took a plea deal and a tiny fine just to get it over with. Even in the plea deal he pled NOT GUILTY.

    I understand if you dont like him because of his views but-

    A) dont even compare him to that scumbag traitor moore. Rush would be more along the lines of Al Franken. While I loathe Franken I dont consider him unpatriotic and I believe the way he goes about getting his message out is the way dissent is supposed to be, mainly without giving aid and comfort to the enemy!

    B) dont make him out to be a criminal or hypocrite. He did not break any laws and he didnt do anything against what he's been preaching either. Becoming hooked on pain killers after 2 extremely major and invasive surgeries is a far cry from some crack whore on Main st or some junkie knocking over liquor stores and shooting heroin.

    Sorry Mac but i'm not buying your brand. Rush cut a deal with the state, and you can scream not-guilty until your lungs bleed. But if you cut a deal, you do so knowing it'll reflect negatively on you for the rest of your life. You accept it. He's got 18 months under this deal to prove himself. If he does so and seeks therapy, the felony charge of Prescription Drug Fraud/Dr. Shopping will be dropped. IF. Now I don't know about you, but that's not a sacrifice i'm willing to make if i'm truly innocent. There is no IF and there is no deal cutting scenario in my playbook. "Because I wanted to get it over with." ?? Give me a break. If he told you he could military press 2,000lbs with his nutsack would you take that on blind faith as well? Of course you wouldn't. But I know you like the guy and you listen to his radio show. You're a loyal fan, that's great. Do what you like.

    There's a **** load of investigators, doctors and experts who by judicial precedent- believe that the guy broke the law. The VAST majority of those saying he's innocent are either paid to say that, or are his devout followers: aka you. But I'm venturing that the vast majority of those experts and investigators know more about this case than either you or me put together because unlike us, they don't have the luxury of our subjective judging or political biases. Bottom line, and this is neither subjective nor political, Rush is famous and well-off with solid connections and that's why he got the rich guy treatment. Or what I like to call... the "IF" parole. Now... re-enter subjectivity and political bias: my judgement of him still stands. He's an *******, and more importantly he's a hypocrite. JUST LIKE MICHAEL MOORE.

    Never wasted my time with that worthless movie. I figured it was just a big propaganda flick done by some fatass with an Anti-Bush agenda twisting and manipulating things to his liking.
